Effectiveness is the most important part of a compliance and ethics program. To ascertain effectiveness, we must look to the United States Federal Sentencing Guidelines which were promulgated in 1991. These guidelines formed the basis for evaluating the effectiveness of a compliance program. In 2020, the United States Department of Justice (DOJ) Criminal Division issued guidance which supplements these guidelines.
